Section 301 tariffs on China (technology transfer, intellectual property and innovation)

In effect (status checked Oct 16, 2026, the last day we checked the Federal Register for later documents).

USTR notice of Oct 7, 2026 (91 FR 64212): “Accordingly, the actions have not terminated and will remain in effect, subject to possible further modifications, including any modifications resulting from the statutory four-year review.”

This Section 301 action on China's technology transfer, intellectual property and innovation practices consists of two 2018 actions, List 1 (effective July 6, 2018) and List 2 (effective August 23, 2018), later modified by List 3, List 4A, product exclusions and the first four-year review. Lists 1, 2 and 3 carry an additional 25% duty and List 4A carries 7.5%. The four-year review raised rates on 14 product groups in steps on September 27, 2024, January 1, 2025 and January 1, 2026, including electric vehicles at 100% and semiconductors and solar cells at 50%. 178 product exclusions run through November 9, 2026. In a notice published October 7, 2026, USTR said it received requests to continue both actions, so they did not terminate on their 2026 anniversaries and remain in effect, with a further review to follow.
